An interview under caution can take place if you voluntarily attend the police station with a criminal defence solicitor or after you have been arrested by the police. In some situations, you can attend the police station by appointment and then be arrested on your arrival at the station.
An interview under caution can be referred to as a PACE interview by the investigating officers or by your police station representative. That’s because a police interview under caution is an interview conducted in accordance with the Police and Criminal Evidence Act (PACE).
At the start of the interview, you will be formally cautioned by the police officer who will tell you that you have a right to remain silent during the interview but the officer will warn you that if you choose to remain silent a jury could draw an adverse inference from your decision not to answer the questions put to you.
A PACE interview is another name for an interview under caution. The interview must be conducted under the PACE codes of practice. If the police breach the codes during the interview your lawyer can raise this to make sure that the interview is conducted fairly.
If you are asked to attend the police station voluntarily you can refuse to go. However, refusal could lead to the police arresting you as part of their investigation.
During a voluntary interview under caution, you can say that you want to stop the interview and leave the police station. Whether you are being interviewed voluntarily or under arrest the interview will be recorded by the police and you have the right to remain silent during the interview.
