There are two types of criminal legal aid:
If you are arrested by the police or interviewed under caution, then you are entitled to free criminal legal aid, whatever your financial circumstances. Although there is always a duty criminal legal aid solicitor on call, you are entitled to ask the police to ring the criminal legal aid solicitor of your choice. You should always ask for Holborn Law if you are taken to a police station.

If the Crown Prosecution Service (CPS) charge you with a criminal offence you may be entitled to criminal legal aid. Whether you qualify for legal aid depends on the seriousness of the offence and your financial circumstances.

You may be entitled to criminal legal aid if your case is going to be heard by the magistrates rather than by the crown court. The test is whether you meet the financial eligibility criteria and if the offence you have been charged with could carry a sentence of imprisonment. However, you could still qualify for legal aid even if you could not be sent to prison for the offence. For example, if you are young or thought to be vulnerable you could qualify for legal aid even though the offence you are charged with does not carry a custodial sentence.
