Criminal Legal Aid

There are two types of criminal legal aid:

  1. Automatic – where everyone is entitled to ask for the services of a criminal legal aid solicitor free of charge.
  2. Application – if you have been charged with an offence and need representation in criminal court proceedings you can apply for criminal legal aid. The success of your criminal legal aid application will depend on your finances and the nature of the offence you have been charged with.

Free Criminal Legal Aid

If you are arrested by the police or interviewed under caution, then you are entitled to free criminal legal aid, whatever your financial circumstances. Although there is always a duty criminal legal aid solicitor on call, you are entitled to ask the police to ring the criminal legal aid solicitor of your choice. You should always ask for Holborn Law if you are taken to a police station.

At Holborn Law we like to help you from the outset of a criminal investigation to make sure that you get the best advice during an interview under caution and, if a prosecution takes place, that you have consistent specialist criminal representation from police station attendance to trial or plea.

Criminal Legal Aid – Charged with an Offence

If the Crown Prosecution Service (CPS) charge you with a criminal offence you may be entitled to criminal legal aid. Whether you qualify for legal aid depends on the seriousness of the offence and your financial circumstances.

Our friendly criminal defence team will just need to ask you a few questions to be able to tell you if you are likely to be eligible for legal aid. Contact the team at Holborn Law today to find out more.

Criminal Legal Aid and the Magistrates Court

You may be entitled to criminal legal aid if your case is going to be heard by the magistrates rather than by the crown court. The test is whether you meet the financial eligibility criteria and if the offence you have been charged with could carry a sentence of imprisonment. However, you could still qualify for legal aid even if you could not be sent to prison for the offence. For example, if you are young or thought to be vulnerable you could qualify for legal aid even though the offence you are charged with does not carry a custodial sentence.

If Holborn Law did not represent you at the police station when you were interviewed under caution, we can still apply for criminal legal aid to represent you in Magistrate court proceedings. Contact us to find out more.

Criminal Legal Aid And Crown Court Proceedings

If you are appearing in the crown court it is best to get expert criminal defence advice from a specialist solicitor. The rules on eligibility for criminal legal aid in the crown court can be complex but you may qualify on financial grounds whether you are on state benefits, employed or self-employed. Our friendly team will just need to ask you a few questions to check your eligibility for criminal legal aid during an initial free telephone call.
