In kidnap and false imprisonment investigations you need expert criminal defence services covering:
You have the right to ask the police to call Holborn Law to help you with your interview under caution. You are not restricted to advice from a duty solicitor.
If you are charged with kidnap or false imprisonment, then you can still call our specialist criminal defence solicitors and we can discuss your circumstances.
You could be accused of kidnap if you take someone against their will. Kidnap does not have to be by force. You can also kidnap someone by using fraud to get them to come with you. For example, you could be accused of abducting a child off the street using force or fraud; by telling the child that the child’s mother has asked you to collect them.
Kidnap deprives an adult or child of their liberty without the person’s consent. It can be done for financial gain (ransom) or as part of sexual offending or drug-related offences or be family related (the kidnap of a spouse or partner).
The offence of false imprisonment involves unlawfully and intentionally restraining a person and not allowing them the freedom to leave. The offence of false imprisonment could take place if you refuse to let someone leave your premises because they owe you money or if you have kept your spouse locked in the family home.
In some situations, you can be accused of both kidnap and false imprisonment. For example, if you kidnapped a person off the street by using force and then took them to a property and refused to release them and there was no means of escape, such as an unlocked door.
If the police suspect you of either kidnap or false imprisonment you are likely to be arrested unless the allegations are historical in nature. With historic allegations, you may be asked to attend a police station voluntarily for an interview under caution. An example of a historic allegation is an adult claiming that when they were a child you falsely imprisoned them.
As any accusation of kidnap or false imprisonment is serious you need specialist criminal law legal advice on the criminal investigation and your response to it. For example, whilst you may want to fully cooperate with the police, there may be very sound reasons why you should exercise your right to silence during a police interview.
At Holborn Law our kidnap and false imprisonment solicitors will tailor their advice to your situation, so you get the best advice and representation to protect your interests.
